To all and singular the Sheriffs of said State greeting
We command you, that of the goods and chattels, lands and tenements of Wade H. Wofford you cause to be made the sum of four hundred dollars as principal and the further sum of one hundred and sixty eight dollars interest up to the 13th day of March 1867.  Also the further sum of nine dollars and fifty cents for cost, with interest on the principal sum from the 13th day of March 1867, which Susan Gaines lately in our Superior Court for said county recovered against Wade H. Wofford for principal, interest and cost and that you have the said several sums of money before the Judge of said court on the second Monday in September next, to render to the said Susan Gaines for principal, interest and cost aforesaid: and have you then and there this writ.  Witness the Honorable James Milner Judge of said Court.  This 15th day of April 1867.

November 2, 1875.  The within land sold this day before the court House door in Bartow County, to W. T. Wofford, and D. W. K. Peacock, the highest bidders, for the sum of eight hundred and fifty dollars. A. M. Franklin, Shff.

State of Georgia, Bartow County.
This indenture made this the second (2nd) day of November in the year eighteen hundred and seventy-five between A. M. Franklin Sheriff of said county, of the first part, and D. W. K. Peacock of the county of Bartow of the second part.  Witnesseth that whereas Wm. W. Rich former Sheriff as aforesaid did on the 26th day of October 1868 levy upon, and said A. M. Franklin Sheriff afterwards expose to sale, the land (part of lot #127) hereinafter more fully described before the Court House door of said county between the legal hours of sale, and after advertising the same according to law in the Cartersville “Standard & Express” for the space of thirty days thereafter, did sell the said lot or lots on the first Tuesday in November 1875, said land being levied on and sold as the property of Wade H. Wofford under and by virtue of an execution issued from the Superior Court of said county of Bartow in favor of Susan Gaines against Wade H. Wofford; and the said Wm. T. Wofford & D. W. K. Peacock having been the highest bidders for the same, and it being knocked off to them as the purchasers at the sum hereinafter named.  Now the said A. M. Franklin Sheriff as aforesaid in consideration of the promises and the sum of eight hundred and fifty dollars, to him in hand paid, at and before the signing and delivery of these presents, the receipt whereof is hereby acknowledged, has granted, bargained, aliened and conveyed; and by these presents does grant, bargain, sell, alien and convet unto the said Wm. T. Wofford & D. W. K. Peacock their heirs and assigns the aforesaid land part of No. 127, lying in the fifth District and third Section and in said county and State, and known in the plan of said county, formerly Cass and Cherokee as one hundred and forty-five acres, more or less of lot of land number (127) one hundred and twenty seven in the 5th Dist and 3d section of said county.  To have and to hold the said part of lot #127, to the said Wm. T. Wofford and D. W. K. Peacock their heirs and assigns, in as full and ample manner as the said Wade H. Wofford might have done. In testimony whereof the said Sheriff has here to set his hand and seal, the day and year above written.

The next deed is D. W. K. Peacock, W. T. Wofford to Mary Wyly selling the above 145 acres of land, lot #127, 5th District and 3rd section for $850.  Deed recorded Nov. 26, 1875.

 

*Literally, "fieri facias", meaning "cause it to be done". Another term is "execution". This is a judicial writ directing the sheriff to satisfy a judgment (such as unpaid delinquent taxes on real or personal property) from the debtor's property.
